1. About Cauce

These Terms and Conditions of Use ("Terms") govern the relationship between Cauce Travel E.I.R.L. ("Cauce") and anyone who requests, books or otherwise uses the travel services offered by Cauce.

Cauce operates primarily through digital channels, including its website, email and Instagram.

2. Our services

Cauce designs, organizes, coordinates and sells personalized trips and other travel services, acting as a travel agency and, depending on the case, as an organizer, intermediary or coordinator of services provided by third parties.

Services that may form part of an itinerary include, among others, accommodation, transportation, flights, trains, excursions, guiding, entrance tickets, permits, activities and other travel services.

Unless expressly stated otherwise, services are physically provided by independent third parties, such as hotels, transport companies, tour operators, restaurants, guides and other providers ("Providers").

3. Quotes and availability

Quotes prepared by Cauce are based on the information, availability and rates in effect at the time they are prepared.

A quote does not, by itself, constitute a booking, nor does it guarantee the availability or price of the services.

Services, rates and availability remain subject to confirmation at the time of booking. In certain cases, Provider rates or conditions may require confirmation or advance payment.

4. Booking confirmation

A booking is considered confirmed when: a) the Client accepts the corresponding proposal; b) the payment required to confirm the booking has been made; and c) Cauce confirms the booking in writing.

The travel confirmation, together with these Terms, forms the contractual basis of the services booked.

The Client must review the information contained in the confirmation and promptly report any error identified in names, dates, services or other relevant details.

5. Prices and payments

Prices are quoted in US dollars (USD) unless expressly stated otherwise.

For bookings made more than forty-five (45) days before the trip's start date, a deposit equivalent to 30% of the total trip value is generally required to confirm the booking.

The remaining balance must be paid no later than 45 days before the trip's start date.

Bookings made within 45 days of the trip's start date generally require payment in full at the time of confirmation.

Cauce may set different payment terms when certain rates or services require advance payment to secure availability.

Payments must be made using the payment methods indicated by Cauce. For bank transfers, fees charged by financial institutions to complete the payment may be the Client's responsibility.

6. Flights, trains and services subject to specific conditions

Airline tickets must be paid in full before issuance. Once issued, they are subject to the fare and airline's own conditions.

Rail services and other services subject to specific conditions are governed by the relevant Provider's policies.

Tickets, permits and entrance rights issued by public entities are subject to the conditions set by the relevant authority. Cauce cannot modify conditions established by such entities.

When a service's conditions materially affect its modification, cancellation, refund or availability, Cauce will inform the Client before confirming that service.

7. Changes requested by the Client

The Client may request changes to their itinerary before or during the trip. Cauce will make reasonable efforts to accommodate such requests, subject to availability.

Changes may result in fare differences, additional costs, or non-recoverable amounts from the Providers involved. Such amounts will be borne by the Client when related to the requested change.

Changes involving a substantial modification or a new itinerary design may be subject to an additional management fee, which will be disclosed to the Client in advance.

8. Postponement or rescheduling

When the Client is unable to travel on the originally planned dates, they may request a postponement or rescheduling of the trip. Cauce will prioritize rescheduling over cancellation whenever feasible.

Rescheduling is subject to availability, current rates and Provider conditions. Fare differences, penalties or non-recoverable amounts resulting from the change will be borne by the Client when applicable.

Cauce may apply previously paid amounts to the new date to the extent such amounts are recoverable, transferable, or accepted as credit by the relevant Providers.

As a general rule, Cauce will not charge its own administrative fee for an ordinary postponement, without prejudice to third-party costs or penalties that may apply.

9. Cancellation by the Client

The Client may request cancellation of their trip at any time through written communication to Cauce.

Upon cancellation, Cauce will make reasonable efforts to recover amounts paid to Providers. Amounts that cannot be recovered due to applicable Provider conditions or the non-refundable nature of certain services will not be refunded by Cauce.

Additionally, Cauce may apply a cancellation management fee equivalent to 20% of the deposit originally paid, with a minimum of USD 300 and a maximum of USD 1,000.

This fee corresponds to the management, coordination, communication and follow-up work required to process the cancellation and manage any resulting refunds.

Amounts actually recovered from Providers will be applied to the corresponding refund, net of amounts that could not be recovered and the applicable management fee.

10. Cancellation, modification or substitution of services by Providers

Providers may modify, substitute, reschedule or cancel certain services for operational, availability, safety, force majeure or other reasons outside Cauce's control.

In these cases, Cauce will manage the situation with the Provider and will seek to offer a reasonably comparable alternative when possible.

When the change results from a breach attributable to the Provider, Cauce will make reasonable efforts to obtain an appropriate resolution and, where applicable, will pass on to the Client any amounts or refunds it is able to obtain from the Provider.

If the Client requests a higher-value alternative than the reasonably available solution, the Client may be responsible for the corresponding price difference.

11. Errors or breaches attributable to Cauce

When a modification or correction is necessary due to an error directly attributable to Cauce in coordinating or booking services, Cauce will seek to correct it promptly and will bear the reasonable costs necessary to resolve the error, in accordance with the circumstances of the case and applicable law.

12. Extraordinary circumstances and force majeure

Unforeseeable or unavoidable circumstances beyond Cauce's or its Providers' reasonable control may affect the provision of booked services. These may include natural phenomena, civil unrest, strikes, government restrictions, closure of attractions, health emergencies, transportation disruptions or similar circumstances.

In such situations, Cauce will, depending on the circumstances: reschedule services; offer reasonably available alternatives; preserve as many itinerary services as possible; and/or manage available credits or refunds.

The financial outcome of these efforts will depend on amounts that can actually be recovered and on the conditions set by Providers or competent authorities.

13. Outstanding payments and release of services

The Client must comply with the payment deadlines set for their booking. When an outstanding payment is not received within the corresponding deadline, Cauce may notify the Client of the need to settle it and, if payment is not made, may release or cancel services whose availability or conditions can no longer be guaranteed.

Any financial consequence resulting from this situation will be subject to the conditions applicable to the booking and to the Providers involved.

14. Travel documentation and requirements

The Client is responsible for holding valid documentation and meeting the immigration, entry, transit, health and other requirements applicable to their nationality and personal circumstances.

Cauce may provide general guidance on requirements relevant to the itinerary, but the Client must verify that they hold the necessary documentation and authorizations with the relevant authorities.

15. Information provided by the Client and personal conditions

The Client must provide complete, truthful and up-to-date information that may be necessary for proper planning and provision of services. This may include information about dietary restrictions, allergies, mobility, physical conditions or other information relevant to travel safety.

The decision to share medical or health-related information rests with the traveler, through the channels made available by Cauce. Failure to disclose relevant information may limit Cauce's or its Providers' ability to take appropriate measures or provide certain services.

Cauce will not be liable for consequences directly resulting from relevant information the traveler failed to disclose, to the extent permitted by applicable law.

16. During the trip

Cauce will act as a point of contact to assist the Client with any issues related to booked services.

The Client must report any issue to Cauce as soon as reasonably possible, so that Cauce and/or the relevant Provider can attempt to resolve it during the trip.

Cauce's assistance does not mean that Cauce automatically assumes costs or liabilities that legally belong to the Provider or to the Client.

17. Unused services, no-shows and early departure

Failure to show up for a booked service may result in its loss and is subject to the relevant Provider's conditions.

Services the Client chooses not to use, in whole or in part, once the trip has been confirmed or started, are not necessarily refundable.

If the Client decides to end or leave the trip early, Cauce may assist in arranging the services necessary for their return, but additional costs and the conditions of unused services remain subject to the applicable terms.

18. Emergencies and travel insurance

In an emergency, the Client must contact local emergency services and inform Cauce of the situation as soon as reasonably possible.

Cauce strongly recommends purchasing suitable travel insurance covering, as needed, medical assistance, evacuation, cancellation, trip interruption, lost luggage and other contingencies.

Cauce does not act as an insurance company and does not guarantee coverage for events or expenses that would fall under an insurance policy.

19. Extraordinary expenses and services booked directly by the Client

Expenses or services booked directly by the Client that are not part of the booking made through Cauce are not managed by Cauce.

When Cauce exceptionally advances an expense on the Client's behalf, that amount is reimbursable by the Client, unless Cauce has expressly agreed to bear it.

20. Minors

Minors may take part in Cauce trips under the responsibility and supervision of their parents, guardians or legal representatives. Specific services may be subject to age restrictions set by Providers or authorities.

21. Cauce's liability

Cauce is liable for fulfilling the obligations that fall directly on it as a travel agency, in accordance with applicable law.

When a service is physically provided by an independent Provider, that Provider is liable for the performance of that service under the terms applicable to it.

Cauce will make reasonable efforts to select and coordinate suitable Providers and to assist the Client when issues arise during the trip.

Nothing in these Terms limits or excludes any liability or rights that cannot be legally limited or excluded.

22. Complaints and Complaints Book

Cauce will seek to directly address any concern or issue related to booked services.

The Client may contact Cauce at hello@cauce.travel and use the complaint mechanisms recognized under Peruvian law, including the Complaints Book (Libro de Reclamaciones) made available by Cauce through its digital channel.

23. Prevention of the sexual exploitation of children and adolescents

Cauce Travel rejects any form of sexual exploitation of children and adolescents and commits to taking the measures required under Peruvian law and MINCETUR regulations.

24. Personal data protection

The processing of personal data provided by the Client is governed by Cauce's Privacy Policy.

25. Intellectual property and use of the website

The text, photographs, designs, logos, materials and other content on Cauce's website are owned by Cauce or used with proper authorization from their respective owners.

Site content may not be reproduced, distributed or used commercially without prior authorization. Use of the website must comply with applicable law and must not affect its operation, security or availability.

26. Changes to these Terms

Cauce may update these Terms to reflect changes in its services, processes or applicable law. The current version published on Cauce's website will govern.

Changes will not affect the conditions of an already-confirmed booking where doing so would unilaterally alter rights or obligations already acquired by the Client, unless there is a legal basis allowing it.

27. Governing law

These Terms are governed by the laws of the Republic of Peru. The parties will seek to resolve any disagreement in good faith through direct communication, without prejudice to the consumer protection rights and mechanisms recognized under Peruvian law.
